It depends on the insurance company and the exclusions in the policy. There have been few court cases where people killed while DUI had to sue to force the life insurance company to pay some won some lost. These are common exclusions. Suicide Clause: The suicide clause usually states that the company will not pay the face amount of the policy if the policyholder commits suicide within two years after purchase. In these cases, the only payment is a refund of premiums paid. This is to prevent someone from buying a policy and to suicide with the intention of clearing their debts and evading a difficult financial situation. Aviation Exclusion: The exclusion of aviation generally indicates that the policy will not pay if the insured dies in a private plane crash and not as a passenger on a commercial flight. States excluding war policy does not pay if the death of the policyholder occurs as a result of war. Exclusion dangerous activity: The exclusion dangerous activity says that there will be no payment if the insured dies while participating in a certain activity, such as hang gliding, climbing, or racing. These exclusions are somewhat rare, however, as most companies will cover you at a higher rate if you regularly participate in these types of activities.
